Help for a loved one who won't accept it.
Petitions for court-ordered assessment and treatment when someone you love is struggling with substance use and will not seek help on their own.
Marchman Act Cases with Curtis LeBlanc
Florida's Marchman Act allows a court to order a person with a substance use problem to be assessed, stabilized and treated, even when they refuse help, if they have lost the power of self-control and are a danger to themselves or others or cannot make rational decisions about their care.
These are some of the hardest situations a family faces. Curtis guides families through the petition and hearings in Palm Beach County with discretion and care, and works with treatment providers on a realistic plan.

Marchman Act Cases questions, answered.
Who can file a Marchman Act petition?
A spouse, guardian or relative can petition, and so can other adults with direct personal knowledge of the person's substance use. Curtis will confirm who can file in your situation.
Is the Marchman Act the same as the Baker Act?
No. The Baker Act deals with mental illness; the Marchman Act deals with substance use. Florida has been aligning the two processes, and some people need both.
Will my loved one get a criminal record?
No. A Marchman Act case is a civil proceeding about treatment, not a criminal case.
How long can treatment be ordered?
The court can order treatment for a defined period, and in some cases extend it. Curtis explains the current time limits and what happens when the order ends.
